In this article, Multi-Level Governance is problematized and treated as a dependent variable. It is argued that processes of globalisation shed considerable light on the development of MLG. In order to conceptualise 'globalisation', I turn myself to the field of International Political Economy, and more specifically neogramscian Critical Theory. Since Critical Theory seems to outline - above all - the distinctive political and policy aspects ofglobalisation, the approach gives way to the development of a causal link between globalisation and governance. (...) The relevance of globalisation towards governance and MLG is further shown by elaborating on a particular level of governance: the subnational sphere of the city. I conclude that Critical Theory is indeed relevant in explaining globalisation and governance, and that its macro perspective may be used in conjunction with a more mesostyle, MLG approach. (shrink)

If climate change represents a severe threat to humankind, why then is response to it characterized by inaction at all levels? The authors argue there are two complementary explanations for the lack of motivation. First, our moral judgment system appears to be unable to identify climate change as an important moral problem and there are pervasive doubts about the agency of individuals. This explanation, however, is incomplete: Individual emitters can effectively be held morally responsible for their luxury emissions. Second, doubts (...) about individual agency have become overly emphasized and fail to convincingly exonerate individuals from responsibility. This book extends the second explanation for the motivational gap, namely that the arguments for the lack of individual agency do in fact correspond to mechanisms of moral disengagement. The use of these mechanisms enables consumption elites to maintain their consumptive lifestyles without having to accept moral responsibility for their luxury emissions. (shrink)

For decades, Martti Koskenniemi has not just been an influential writer in international law; his work has caused a significant shift in the direction of the field. This book engages with some of the core questions that have animated Koskenniemi's scholarship so far. Its chapters attest to the breadth and depth of Koskenniemi's oeuvre and the different ways in which he has explored these questions. Koskenniemi's work is applied to a wide range of functional areas in international law and discussed (...) in relation to an even broader range of theoretical perspectives, including history, political theory, sociology and international relations theory. These invaluable insights have been expertly brought together by the volume editors, who identify the key and common themes of many of the book's contributions. Religion can affect public support for the European Union. However, specifying the circumstances under which religion may become a stronger predictor of EU-support has so far been neglected. This article shows that the media play a role in this process and it is investigated to what extent the presence or absence of references to religious issues in EU news coverage primes people's religious attitudes to contribute to their evaluation of the EU. For this purpose, a content analysis of the amount (...) of religious news items in EU coverage in German and Dutch newspapers between 1997 and 2007 was conducted. Two points in time were chosen — 1998, when only a small amount of religious news items appeared in EU coverage, and 2005, when religious items reached a peak. Eurobarometer data were used to test the media priming proposition. The findings show that an increasing religious dimension in media coverage about the EU primes a linkage between religious and political considerations and thus influences the strength of the impact of religion on attitudes towards the EU. In this empirical study, we investigate _what_ and _how_ teachers in Dutch universities of applied sciences (UAS) think they contribute to the development of students’ ethical compasses. Six focus groups were conducted with teachers across three programmes: Initial Teaching Education, Business Services, and Information and Communication Technology. This study revealed that teachers across the three different professional disciplines shared similar ideas about what should be addressed in the development of students’ ethical compasses. Their contributions were grouped into three core themes: (...) creating students’ moral awareness, developing students’ moral skills and promoting students’ moral professional behaviour. The majority of the teachers used a wide range of planned and unplanned pedagogic–didactic actions (reflecting individual learning and cooperative and group learning) to enhance the development of students’ ethical compasses. However, teachers’ strategies were mostly unstructured and unreflective and depended on the individual teacher’s ability and knowledge to address moral themes. Furthermore, the study revealed two incompatible ideals: as role models, the teachers aimed to exemplify explicitly how to be a professional with an ethical compass. However, they also wanted to adopt a neutral stance because they were afraid to manipulate the students’ ethical compasses. Therefore, they avoided promoting _the_ ethical compass that they believed to be the best. (shrink)

The aim of this empirical study is to understand how bachelor students at universities of applied sciences (UAS) use their ethical compasses during internships. Semi-structured interviews were held with 36 fourth-year bachelor students across four UAS and three different programs in the Netherlands: Initial Teacher Education, Business Services, and Information and Communication Technology. To our knowledge, no studies appear to have investigated and compared students from multiple professional fields, nor identified the dynamics and the sequence of the strategies in the (...) decision-making process that students use when faced with ethical dilemmas during internships. We found that students’ ethical dilemmas stemmed from: mentors’ or managers’ behaviours/requests, colleagues’ behaviours, organisations’ morally questionable incentives, pupils’ home situations, and pupils’ behaviours/personal stories. The majority of students used multiple strategies and first investigated the ethical dilemmas they encountered and then avoided, intervened, delegated responsibilities, or adjusted to their environments. Students’ values played an important role in experiencing an ethical dilemma, however, these values were not always acted upon. We identified that rather students’ beliefs about having influence and/or ownership (or not), personal interest(s) and power relations influenced the way how they used their ethical compasses. Thus, instead of navigating on moral standards (of their profession), students reacted on beliefs which reflected the ways in which they constructed their internship contexts, social relationships and their own (and others) needs. As a result, half of the mentioned dilemmas were resolved in a prudent-strategic manner (e.g., by prioritising personal interests), instead of morally. This indicates that students did not always convert (moral) values into moral action and did not use their ethical compasses in the way UAS aspires. Finally, this study found that the ways in which students used their ethical compasses were strongly influenced by their environments. (shrink)

A social scientific survey on visions of human/nature relationships in western Europe shows that the public clearly distinguishes not only between anthropocentrism and ecocentrism, but also between two nonanthropocentric types of thought, which may be called “partnership with nature” and “participation in nature.” In addition, the respondents distinguish a form of human/nature relationship that is allied to traditional stewardship but has a more ecocentric content, labeled here as “guardianship of nature.” Further analysis shows that the general public does not subscribe (...) to an ethic of “mastery over nature.” Instead, practically all respondents embrace the image of guardianship, while the more radical relationships of partnership and participation also received significant levels of adherence. The results imply that ethicists should no longer assume that the ethics of the public are merely anthropocentric. Finally, they call into question the idea of a single form of ecocentrism and favor a hermeneutic virtue ethics approach to the study of the interface between ethics and action. (shrink)

The present book is the result of the conference 'Renovatio, inventio, absentia imperii. From the Roman Empire to Contemporary Imperialism', held in Brussels at the occasion of the 75th anniversary of the Academia Belgica in Rome (September 11-13, 2014). At the heart of the conference was the 'reception', 'Nachleben' or 'permanence' of the Roman Empire, of an idea and a historical paradigm which since classical Antiquity has supported the most widespread claims to obtain and consolidate power. The volume's focus is (...) on culture in a broad sense, i.e. including besides the arts, philosophy, religion and, most importantly, discourse. As such, a wide array of themes are subjected to academic scrutiny. Whereas the main focus is on Europe and North America, some contributors also reach out towards non-Western contexts, whether or not directly related to the Roman example. A theoretical and sociological dimension is also added thanks to the discussion on methodological issues. More specifically, the following question(s) receive particular attention: what is our position as researchers, embedded in a contemporary, often Western, democratic and capitalist context; what about the notion of empire itself, its constituent elements and the kind of ideological prerogatives to which it is generally subjected; in other words, apart from the many historical variants and instances of reception of empire, through which filters can, and inevitably do, we approach this topic? A question that has become ever more pregnant since the beginning of the twenty-first century, after the dissolution of the Soviet Union, the events of September 11, which have revivified what could be called American 'imperialism', and at a time when an essentially economic variant, driven by 'emerging' powers such as China, has increasingly contested existing power structures."--Page [4] of cover. Legal Realism Regained presents a comparison between the legal realists, a group of pragmatic legal theorists from the 1920s and 1930s, and critical legal studies, a movement of postmodern legal theory during the end of the twentieth century. The book argues for a return to legal realism and the classical pragmatism of John Dewey and William James and for a rejection of the postmodern critique of critical legal studies. It discusses the two movements with respect to three topics: their view (...) of history, their view of social science, and their view of language. Rejecting the claim that critical legal studies can be seen as the heir of legal realism, Legal Realism Regained argues that, with respect to each of these three topics, the realists still present a stronger argument than their more radical descendants. Institutional theory of law (ITL) reflects both continuity and change of Kelsen's legal positivism. The main alteration results from the way ITL extends Hart's linguistic turn towards ordinary language philosophy (OLP). Hart holds – like Kelsen – that law cannot be reduced to brute fact nor morality, but because of its attempt to reconstruct social practices his theory is more inclusive. By introducing the notion of law as an extra-linguistic institution ITL takes a next step in legal positivism and accounts (...) for the relationship between action and validity within the legal system. There are, however, some problems yet unresolved by ITL. One of them is its theory of meaning. An other is the way it accounts for change and development. Answers may be based on the pragmatic philosophy of Charles Sanders Peirce, who emphasises the intrinsic relation between the meaning of speech acts and the process of habit formation. (shrink)

Language-related potentials are increasingly used to objectify adaptive neuroplasticity in stroke-related aphasia recovery. Using preattentive [mismatch negativity ] and attentive phonologically related paradigms, neuroplasticity in sensory memory and cognitive functioning underlying phonological processing can be investigated. In aphasic patients, MMN amplitudes are generally reduced for speech sounds with a topographic source distribution in the right hemisphere. For P300 amplitudes and latencies, both normal and abnormal results have been reported. The current study investigates the preattentive and attentive phonological discrimination ability in (...) 17 aphasic patients at two timepoints during aphasia recovery. Between the two timepoints, a significant improvement of behavioral language performance in both languages is observed in all patients with the MMN latency at timepoint 1 as a predictive factor for aphasia recovery. In contrast to monolinguals, bilingual aphasic patients have a higher probability to improve their processing speed during rehabilitation, resulting in a shortening of the MMN latency over time, which sometimes progresses toward the normative values. The characterisation of anthropogenic climate change as a violation of basic human rights is gaining wide recognition. Many people believe that tackling this problem is exclusively the job of governments and supranational institutions (especially the United Nations Framework Convention on Climate Change). This argument can be traced back to the delegated authority model, according to which the legitimacy of political institutions depends on their ability to solve problems that are difficult to address at the individual level. Since the institutions created (...) to tackle climate change fail to do so, their legitimacy is under great pressure and can only be saved by considerations of feasibility. We argue that democratically elected representatives are able to claim that a more robust climate policy is unfeasible, but only because the mandate we as citizens grant them is very restrictive. Instead of shifting responsibility for the thoroughly inadequate response to climate change fully to political representatives, we should highlight the failure of the political community as a whole to fulfil its responsibility at the input-side of the delegation of authority. When individual voters fail to fulfil the minimal obligation to at least vote for parties that explicitly advocate robust climate policies, they cannot hide behind the delegated authority argument, but should accept their complicity in the massive violations of basic human rights caused by the failure to successfully tackle climate change. This article focuses on how leaders of new right-wing populist parties are portrayed in the mass media. More so than their established counterparts, new parties depend on the media for their electoral breakthrough. From a theoretical perspective, we expect prominence, populism, and authoritativeness of the party leaders' media appearance to be essential for their electoral fortunes. We used systematic content analyses of 17 Dutch media outlets during the eight weeks prior to the 2006 national elections and compared the appearances of (...) four right-wing populist and seven mainstream party leaders. This article makes two contributions to the existing literature: First, we develop valid and reliable indicators of authoritativeness and populism and apply them to a systematic content analysis. Second, we show that more successful right-wing populist leaders were more prominent during the election campaign and that the most successful right-wing populist leader also appears more authoritative in the news. En las últimas décadas, las organizaciones se dirigen hacia un enfoque más igualitario, conforme a los ideales del ‘New Work Order’, razón por la cual los modelos jerárquicos con un solo líder ‘poderoso’ se hacen cada vez menos aceptable. Por motivo de esta tendencia general, ha surgido un interés creciente por una conceptualización compartida o múltiple del liderazgo, como el ‘co-liderazgo’. Sin embargo, pocas investigaciones se han concentrado en la manera en que se establecen constelaciones del co-liderazgo durante la interacción (...) desde una perspectiva discursiva. Además, aunque este proceso del co-liderazgo se realiza sobre la base de recursos verbales y no verbales, el conocimiento sobre el desarrollo de este proceso queda limitado. En este artículo, incorporamos una perspectiva multimodal y, con el método del análisis del discurso, analizamos la constelación del co-liderazgo en una reunión de un movimiento juvenil. Para analizar los procesos del liderazgo en la interacción, los análisis se basan en los conceptos de la postura y la posición deóntica proximal y distal. Además, se investiga el papel de la epistémica en relación con la representación de los derechos deónticos. De los análisis, se desprende que, en esta reunión, hay una distribución clara de los derechos deónticos, a veces relacionada con la posición epistémica de los participantes. Además, el análisis muestra que el co-liderazgo siempre es un proceso esencialmente colaborativo en el que todos los participantes contribuyen. (shrink)

In this contribution to the colloquium, I argue why and how I lost interest in the overall structure of social networks even though Big Data techniques are increasingly simplifying the collection, organisation, and analysis of ever larger networks. The challenge that Big Data techniques pose to the social scientist, I think, is of a different nature. Big Data on social actors mainly record events, e.g. interactions between human beings that happen at a point in time. In contrast, social network analysts (...) tend to think in terms of social relations that exist over a timespan. The challenge, then, is to rethink our conceptions and models of social relations and social structure. I conceptualize social structure and social relations as forces. I propose modelling these forces with regression models for longitudinal interaction data. (shrink)

There is an increasing call for preventive state interventions in so-called families at risk—that is, interventions before any overt harm has been done by parents to their children or by the children to a third party, in families that are statistically known to be liable to harm children. One of the basic principles of liberal morality, however, is the citizen's right to be free from state intervention so long as no demonstrable harm has been done. On the other hand, Joel (...) Feinberg interprets the harm principle as a harm prevention principle, so that the risk of harm also might be a reason for interference. The question that needs to be asked, therefore, is whether enforced preventive intervention in the cases where families are judged to be at risk can be justified within the limits of liberalism. The housing sector is currently under pressure: demographic shifts, urbanisation as well as the availability and costs of housing have led to increasing prices. Concerns are being raised that these rising housing costs could lead to intergenerational conflicts. While older generations often live in their privatelyowned dwellings, younger cohorts struggle to become homeowners, moving the field of housing into the spotlight of national debates. We analyse the importance of housing for Europeans using data from Eurobarometer. Results show that the relevance (...) of housing increased between 2008 and 2018. However, generational differences were found: while older and younger people see housing as an important topic at the country level, only the younger generation seems to be affected personally. Visions of nature are defined as public views on what nature is, what values are carried by nature and what is the appropriate relationship between humans and nature. They were studied in Lubelski region, Poland. With respect to the first, respondents expressed that human influence and naturalness do not exclude each other. One result of the values survey was that respondents acknowledged nature's intrinsic value. The study into the relationship between humans and nature showed that the respondents adhered strongly to (...) a steward type of relationship, and that more ecocentric images were adhered to for a lesser, but substantial degree. The expression that professionals should be led by their moral or ethical compass is increasingly used by academics, policy makers, professionals, and educational institutes. Dutch universities of applied sciences (UAS), for example, explicitly aim to educate their students to become professionals equipped with a moral compass. This moral or ethical compass is a metaphor of which people intuitively grasp its meaning, but our literature review also shows that various interpretations are possible. We found three clusters of proposed ethical compasses expressing (...) its a) content, b) form, or c) use, which we present in this article. Thereafter, we evaluate which compass can meaningfully assist (young) professionals and, therefore, should be part of the aims and content of education provided by UAS. Based on this evaluation, we describe the possibilities and boundaries of UAS’ contribution to the development of their students’ ethical compass. (shrink)

Global university rankings have become increasingly important ‘calculative devices’ for assessing the ‘quality’ of higher education and research. Their ability to make characteristics of universities ‘calculable’ is here exemplified by the first proper university ranking ever, produced as early as 1910 by the American psychologist James McKeen Cattell. Our paper links the epistemological rationales behind the construction of this ranking to the sociopolitical context in which Cattell operated: an era in which psychology became institutionalized against the backdrop of the eugenics (...) movement, and in which statistics of science became used to counter a perceived decline in ‘great men.’ Over time, however, the ‘eminent man,’ shaped foremost by heredity and upbringing, came to be replaced by the excellent university as the emblematic symbol of scientific and intellectual strength. We also show that Cattell’s ranking was generative of new forms of the social, traces of which can still be found today in the enactment of ‘excellence’ in global university rankings. (shrink)

In his Inleidinge tot de Hollandsche Rechts-geleerdheid, Hugo Grotius wrote an accessible introductory overview of Hollandic law, in which he combined insights from the learned law (ius commune) with the particular law of Holland. The Inleidinge was read by generations of Dutch law students, and would thus become very influential in the Roman-Dutch tradition. This contribution studies how the topic of representation, especially in a business context, was treated in Grotius’s Inleidinge. On the basis of an analysis of the Justinianic (...) Corpus iuris, the medieval ius commune tradition and – especially – early modern scholarship from the Low Countries, it is argued that Grotius’s Inleidinge by and large followed the communis opinio among the learned scholars, although on one important point – namely the acquisition by a third party of a claim on the basis of a stipulatio alteri – Grotius went beyond that communis opinio and, thus, opened the way for a gradual wider legal acceptance of active direct representation. The capabilities approach of Amartya Sen and Martha Nussbaum has become an influential viewpoint for addressing issues of social justice and human de- velopment. It has not yet, however, given adequate theoretical consideration to the requirements of environmental sustainability. Sen has focussed on the instrumental importance of human development for achieving sustainability, but has failed to consider the limits of this account, especially with respect to consumption-reduction. Nussbaum has criticised constraining material consumption for its paternalistic prescription of one particular conception (...) of the good life, without considering it as an imperative of justice. We discuss two possible extensions of the capabilities approach. First, the concept of ca- pability ceilings contains several attractive elements, but it also suffers from some shortcomings. Therefore, second, we advocate constraining people’s combinations of functionings in accordance with a personal budget which con- sists of a fair share of environmental resources. (shrink)

The basis of Belgium's post-war social and economic reforms was the social-solidarity agreement between the trade-unions and the employers. This «historical compromise» aimed at securing social security and a legal ground for the workers' co-management in the economic life, in exchange for social peace and aid in attaining a productivity-raise.From 1945 till 1948 National Labour Conferences and Parliament discussed the matter, especially the introduction of Works Councils, which raised ideological resistance. The Socialists, favourable towards the Works Councils in undertakings, claimed (...) economic and financial powers for them. The Catholic were in favour of co-management, cooperation between workers and employers and workers' co-responsibility. Theemployers, fearing a restriction of their powers and a threat of collectivizing, were very suspicious.An inter-catholic agreement between workers and employers allowed them to formulate a unanimous attitude towards the Works Councils. A Socialist-Catholic compromise in Parliament resulted in the law on the organizing of the industry. This law reserved for the Works Councils a mainly advisory role in social matters. Their powers were very limited. Their composition was determined by cooperation and commoninterests.The first Works Councils-elections happened in 1950. (shrink)

Between 1950 and 1954 Belgium had a homogeneous catholic majority in Parliament. Theoretically this brings about a stable government, but in real term it caused a lot of trouble. The Christian People's Party changed its prime minister three times. Different reasons explain this attempt to further the particracy from a party one had not expected this. First, the outcome ofthe Royal Question creates a tension between the party and the government. The party can not fulfill its election promises. Second, the (...) homogeneous majority is based on a heterogeneous party, where progressives and conservatives, Flemish and Walloon politicians determine the decision-making. Moreover, the party as such claims its position in the decision-making process. The parliamentary groups and the government are considered as executors ofa partyprogram and must thereforebe subordinated to the party. The process where parties expanded to the dominant actor in the political system, becomes clear. (shrink)

In this paper, we introduce the Societal Readiness Thinking Tool to aid researchers and innovators in developing research projects with greater responsiveness to societal values, needs, and expectations. The need for societally-focused approaches to research and innovation—complementary to Technology Readiness frameworks—is presented. Insights from responsible research and innovation concepts and practice, organized across critical stages of project-life cycles are discussed with reference to the development of the SR Thinking Tool. The tool is designed to complement not only shortfalls in TR (...) approaches, but also improve upon other efforts to integrate RRI, sustainability, and design thinking in research and innovation cycles. Operationalization and early-stage user tests of the Tool are reported, along with discussion of potential future iterations and applications. (shrink)

AimsThis preliminary study aimed to investigate therapy-induced electrophysiological changes in persons with primary progressive aphasia. The investigated event-related potential components associated with language processing were the mismatch negativity, P300, N400, and P600.MethodsA linguistic ERP test battery and standardized language assessment were administered in four patients with PPA of which two received speech-language therapy and two did not receive therapy. The battery was administered twice with approximately 6 months in between in each patient. The results of the follow-up assessments were compared (...) to the results of the initial assessments.ResultsAlthough the results of the behavioral language assessment remained relatively stable between the initial and follow-up assessments, changes in the mean amplitudes, onset latencies, and duration of the ERP components were found in the four patients. In the two patients that did not receive SLT, an increased delay in 50% and a decreased mean amplitude in 25% of the measured ERP components were found. The electrophysiological changes found in the patients that received SLT were variable. Interestingly, the mismatch negativity and the N400 effect elicited by the categorical priming paradigm were less delayed and had an increased mean amplitude at the follow-up assessment in the patient with the non-fluent variant who received SLT. In this patient, the P600 component was absent at the initial assessment but present at the follow-up assessment.ConclusionAlthough no clear patterns in electrophysiological changes between patients who received SLT and patients who did not receive SLT were found by our preliminary study, it seems like the SLT induced improvements or compensation mechanisms in some specific language comprehension processes in the patient with the NFV. The results of this study are still preliminary because only four heterogeneous patients were included. Future studies should include larger patient groups of the three clinical variants because the therapy-induced electrophysiological changes might differ depending on the clinical variant and the underlying pathology. In the Belgian constitutional order, there is no room for any direct political powers to be exercised by the King. Even on the occasion of a crisis- when the Cabinet tenders its resignation or when the Kingperforms His constitutional mission in the process towards the formation of a new government ; His freedom of action is restricted by the objective context, defined mainly by the political parties.The King, however, retains the possibility of exercising his political influence. This influence may be (...) all the more important in a country, such as Belgium, where the parliamentary system of proportional representation and the constitutional rule that both major linguistic groups be equally represented in the Cabinet -amongst other factors - cause a cabinet formation to be a complex and delicate process. Investigations into inter-level relations in computer science, biology and psychology call for an *empirical* turn in the philosophy of mind. Rather than concentrate on *a priori* discussions of inter-level relations between 'completed' sciences, a case is made for the actual study of the way inter-level relations grow out of the developing sciences. Thus, philosophical inquiries will be made more relevant to the sciences, and, more importantly, philosophical accounts of inter-level relations will be testable by confronting them with what really happens (...) in science. Hence, close observation of the ever-changing reduction relations in the developing sciences, and revision of philosophical positions based on these empirical observations, may, in the long run, be more conducive to an adequate understanding of inter-level relations than a traditional *a priori* approach. There is a well-established relationship between isolation and both morbidity and mortality in the context of addiction recovery, yet the protective effects of intimate and familial relationships have not been adequately assessed. The current paper uses the European Life In Recovery database to assess the association between relationship status and living with dependent children on recovery capital of people in recovery from drug addiction, operationalised by the Strengths And Barriers Recovery Scale. The study participants were drawn from the REC-PATH study (...) and supplemented by a second sample recruited by the Recovered Users Network across various European countries, resulting in a combined sample of 1,313 individuals completing the survey, primarily online. The results show that, in recovery, those who are married or co-habiting reported significantly greater recovery strengths and fewer barriers to recovery, and reported greater gains in recovery capital across their recovery journeys. Similar associations are found for participants who have dependent children living with them. There is also some indication that this association is stronger for female than for male participants. Finally, having more people that one can rely on and a greater proportion of people in recovery in the social network are both linked to greater recovery capital and greater self-reported growth in recovery capital. We conclude that this study provides further evidence in favour of a “social cure” in recovery, in which close familial ties are associated with stronger recovery resources. (shrink)
